If abortion is made Illegal, what should happen to women who then have abortions?

Should they also be put to death or given life in prison? If you believe that abortion is murder, then how can they be punished any differently than how society punished murderers now?

If you don’t punish them at all, then why even make it illegal?

Best Answer: First of all, abortion should not be made illegal for many reasons, but pertaining to your question, you are correctly assuming that women will find a way to have abortions. These abortions may be done by back ally butchers with coat hangers, like they were in the past. If this happens, we needn't worry about punishing these women, they will probably die from infection or complication from the procedure.

It is technically first degree murder. On top of that, it is murder of an infant (technically fetus, but it doesn’t matter). Whatever the state’s punishment is for a first degree murder of a baby, that is what they will get.

I don’t think that in the law they will say that it is murder. They will write it in a way that says that it hurts women, hurts children, has links to breast cancer.

There should be something like a 5 year awareness plan where lighter sentences are meted out for abortion – to be realistic and pragmatic and allow time for a paradigm shift. Say 3-5 years in jail. After that it should be changed to life in prison or the death penalty depending on the circumstances.

Abortion is probably the sickest and most vile thing this world has ever seen and it makes the Jewish Holocaust look like stubbing a toe.

Killing the defenseless just because they are inconvenient and people can’t keep it in their pants. Mankind is sick.

Better question… whats going to happen with all the unwanted babies. While it is true that healthy babies get adopted fast… Crack babies get left in the foster system that is already over loaded. How many of these women getting abortions do you think are actually going to take care of their bodies during an unwanted pregnancy they are forced to have???

When women are pregnant, it is not uncommon for their decisions to be severely impacted by hormones. Women should not be prosecuted either for having abortions, or for infanticide, for at least six months after giving birth.

However, should anyone ASSIST such a woman, they would be morally culpable. Therefore any laws against abortion would apply severe penalties to the Doctors, nurses, or anyone else other than the mother participating in the obtaining of an abortion.

People who have compassion for a woman in such a state need to direct her to proper counseling and medical assistance to help her cope.

I also think that abortion will not become illegal but i do hope that partial birth abortion becomes illegal.
However I think there should be stricter guidelines placed on abortions. Like having those choosing to abort should be required to watch a video of an abortion procedure to see and be aware of exactly what action they are taking. many women see these videos or pictures of the procedures results only after they have had already had the procedures and it then haunts them for life.

just to add, if made illegal have strict laws towards pregnant women to insure that they stay healthy, such as incarceration for drinking, smoking, drug use. These could be enforced at Ob visits by doing mandatory tests to check for traces of these in their bodies. But also make it law that pregnant women have to seek prenatal care. But then again is this too comunistic? Eventually we will have population laws here just like in China or the world is going to run out of room andresources.

    >>If you believe that abortion is murder, then how can they be punished any differently than how society punished murderers now?< <

For the same reason we punish infanticide differently -- because we recognize that a mother who kills her baby is not thinking clearly. It is not a judgment on the value of the baby's life.

"We understand that we see these cases as being a distinct, unique set of cases. It is different when a mother kills her child, It's not like other murders, so we treat them differently." -- DePaul University law professor Michelle Oberman, author of "Mothers Who Kill Their Children: Inside the Minds of Moms from Susan Smith to the 'Prom Mom.'"

It couldn’t be considered murder because legally and biologiclly a fetus isn’t considered a person.

There would be no point making it illegal because it would stil happen just as much.

I am outraged at several answers to this question. Until you are put in that position under those circumstance, who are you to judge?
I, first of all, doubt that it will be made illegal. If it is, the courts will have to decide that a fetus is a human being and all states must agree. This will then go hand in hand with people who murder a pregnant woman and will no longer get sentenced for one murder, but two. This will never fly. There’s too much controversy trying to decide when a fetus is a human being.
Punishment would have to be individual based on circumstances, which again, is time consuming and something that’s not needed.
Speaking for everyone who’s had an abortion, give your heads a shake!

As said in an earlier comment, abortion will never become illegal, and I believe it most definitely should stay this way. Abortion is not murder, therefore if it ever became illegal, those who would still get abortions (via back alley abortions, which are entirely dangerous in most cases) would not be put on trial for murder, nor have a sentence of murder.

See, I don’t even believe that abortion should be illegal because it is not a human. It is a fetus. We don’t start counting how old a baby is the second that it is conceive, we start counting how old it is the second that it comes out of the womb. I see nothing wrong with abortions, to be honest.
